Dear Sir/Madam, I write to formally record verbal instructions received from your Client Representative, Clayton, on 14 May 2026 at 01:56 hours regarding the triple truck access works at Bonnie Downs, Ch-210.050. The Client Representative stated: "We are now at the 10th hour and this should have been completed." This instruction was given in the context of completion expectations for the access track works currently in progress. I must advise that the works being directed by your Client Representative may require the Contractor to work outside the approved GDP clearing boundaries. Despite receiving both verbal and written directions from Clayton on four separate occasions, our site assessment indicates potential boundary compliance issues. Our Superintendent has exercised due diligence by requesting boundary remarking to ensure regulatory compliance before proceeding. The Contractor acknowledges the urgency expressed by your Representative; however, we have a duty of care to ensure all works remain within approved environmental clearing limits. The uncertainty regarding clearing boundaries has caused delay to the works, as the Contractor cannot proceed with confidence until proper boundary verification is completed. The Contractor hereby puts the Principal on notice that the delay caused by scope clarification requirements and boundary verification may give rise to an Extension of Time claim. This delay is not attributable to the Contractor but results from the need to clarify approved work limits and resolve conflicting directions. The Contractor reserves its rights to claim additional time and cost associated with any out-of-scope works that may be required to comply with the Client Representative's directions, should the directed works fall outside the approved clearing boundaries. We respectfully request an urgent site meeting with your Representative, our Superintendent, and a qualified surveyor to physically verify and agree upon the approved clearing boundaries before works continue. This record is made to document verbal instructions given by the Client Representative.
