Dear Sir/Madam, We refer to works undertaken on 29 July 2026 at the Huntly Road Upgrade project, specifically within the section CH1200 to CH2000. We advise that your representative, Mr Lawrence Chang, verbally instructed the Contractor to grade and construct a new road section of approximately 5,000 m² in this area. These works fall outside the limits and scope of the original Contract and were not included in the agreed Contract Documents. Notwithstanding the absence of written instruction, the Contractor proceeded with these works on the basis of the verbal direction given, in order to avoid delay to the Client's operations. This letter serves as a Verbal Instruction Report and Field Record (VIRF) to formally document the instruction given. The Contractor requests that the Client Representative provide written confirmation of this instruction, together with confirmation of the authority under which it was issued, within seven (7) days of the date of this letter. The Contractor further wishes to place on record that the works described above constitute out-of-scope works under the Contract. Accordingly, the Contractor reserves its full rights to claim additional costs and time associated with the performance of these works, including but not limited to labour, plant, materials, and extended preliminaries. The Contractor will not proceed with any further out-of-scope works beyond those already completed without written instruction and prior agreement on commercial terms. As a direct consequence of the above instruction, the Contractor's program has been adversely affected, with progress now recorded as behind schedule. The Contractor hereby gives notice to the Principal of a potential Extension of Time claim arising from this event. A detailed program impact assessment and supporting cost documentation will be prepared and submitted in due course in accordance with the Contract. Given the scale and commercial significance of this instruction, the Contractor considers it prudent to formally record the circumstances of this event and to seek the Client's written confirmation and commercial agreement before any further works of this nature are undertaken. This record is made to document verbal instructions given by the Client Representative. The Contractor reserves the right to claim additional cost and/or time associated with compliance with this instruction. We would appreciate your prompt attention to this matter and look forward to your written response confirming the instruction and agreeing a path forward for the associated variation and time claims.
