Dear Sir/Madam, This letter serves as formal notice of several matters arising from works on 8 May 2026 that require immediate attention and documentation. VERBAL INSTRUCTION - VEGETATION CLEARANCE LOT 12B We hereby record that at 14:30 on 8 May 2026, Roger Smith (Client Representative) verbally instructed the Contractor to commence vegetation clearance on Lot 12B. The Client Representative advised that this work was required to be completed before the council inspection on Monday and instructed us to proceed despite our advice that this work falls outside our contract scope. We commenced this work under protest at 15:00 on 8 May 2026. This work is clearly outside the contract boundary and constitutes additional scope. The Contractor reserves the right to claim additional cost and/or time associated with this out-of-scope work. This record is made to document verbal instructions given by the Client Representative. The Contractor reserves the right to claim additional cost and/or time associated with compliance with this instruction. CLIENT-CAUSED DELAYS AND EXTENSION OF TIME NOTICE We hereby put the Principal on notice of a potential Extension of Time claim arising from the following client-caused delays: 1. RFI-042 (structural reinforcement details for pier caps) was submitted on 4 May 2026 with a response due on 8 May 2026. As at 17:00 on 8 May 2026, no response has been received, causing the deferral of concrete pours at Ch 1240-1260. 2. The Principal's concrete pump was not made available as promised at 06:30 on 8 May 2026, further impacting the planned concrete pour. 3. The Principal's engineer was not available for required set-out verification at Ch 1260. As a direct result of the Principal's failure to respond to RFI-042 within the agreed timeframe and provide promised resources, the project is now running 3 days behind program. VARIATION CLAIM - CONCRETE TRUCK STAND-DOWN COSTS Due to the Principal's failure to provide approved drawings via RFI-042 response, 18m³ of ready-mix concrete (32MPa) booked for the pier cap pour had to be stood down at the Contractor's cost. We hereby notify the Principal of our intention to claim these concrete truck stand-down costs as a variation to the contract. The Contractor was ready and able to proceed with the scheduled concrete pour but was prevented from doing so by the Principal's failure to provide necessary approvals within the agreed timeframe. REQUEST FOR IMMEDIATE ACTION We respectfully request: 1. Immediate written confirmation of the instruction to proceed with vegetation clearance on Lot 12B, including variation pricing arrangements 2. Urgent provision of the outstanding RFI-042 response to enable concrete pours to resume 3. Confirmation of availability of the Principal's concrete pump for rescheduled works 4. Written acknowledgment of the delay events and their impact on the contract program We reserve all rights under the contract in relation to these matters and look forward to your prompt response to minimise further delays to the project. Hold point HP-14 for pier cap concrete pour deferred — RFI-042 outstanding. ITP-07 subgrade inspection completed and signed off at Ch 1220–1235. No NCRs raised today.
1. PM (D. Hartley) advised that verbal direction from Roger Smith (client rep) to clear Lot 12B vegetation must be documented as a VIRF and submitted to client today. Work commenced under protest pending formal written instruction. 2. PM to follow up RFI-042 directly with principal's engineer first thing tomorrow. If no response by 0900, formal delay notice to be issued. 3. Concrete truck stand-down costs to be claimed as a variation — truck booked and stood down at contractor's cost due to client's failure to provide approved drawings.
