Dear Sir/Madam, We write to formally record a verbal instruction received on site on 29 May 2026. At 1430 hours, Mr Roger Rickerby (Superintendent, Example Principal Pty Ltd) verbally instructed our crew to extend the pavement widening works 200 metres beyond the contract limit at chainage 12.000 to the McPhee Road intersection. Mr Rickerby stated this extension was required for traffic safety purposes and requested the crew to "just keep going" through the following day. We advised Mr Rickerby that this instruction extends beyond the contractual scope of works as defined in Clause 2 — Description of Works, which limits our works to chainage 0.000–12.000. Mr Rickerby acknowledged this scope issue and advised he would "sort it out with head office." However, no written Superintendent's Direction has been received to date. Our site supervisor has correctly instructed the crew to hold works at the contract limit (chainage 12.000) pending receipt of formal written direction from the Principal. We cannot proceed with works beyond the contract scope without proper documentation and commercial assessment. The Contractor reserves the right to claim additional cost and/or time associated with the proposed extension of pavement works, which will require variation assessment for materials, plant, labour, traffic management, and associated overheads.
