VERBAL INSTRUCTION RECORD This letter serves as formal record of the following verbal instruction: Date: 11 May 2026 Time: 05:09 hours Client Representative: Stuart Barnes Instruction: Cease contracted scope works and perform detailed earthworks at Ch209 Resources Directed: Two operators, one excavator, and one spotter Estimated Duration: Two days OUT-OF-SCOPE WORKS NOTICE We hereby notify you that the detailed earthworks at Ch209 fall outside the contracted scope of works. The Contractor has commenced these works under your direct instruction, however we formally reserve our rights to claim additional time and cost for: • Labour costs for two operators over two days (24 man-hours per day) • Plant hire for excavator including 2 hours idle time caused by the scope change • Spotter costs for the duration of the works • Site overheads and margins • Disruption costs arising from interruption to planned contracted works EXTENSION OF TIME NOTICE We hereby put the Principal on notice of a potential Extension of Time claim arising from this client-directed scope change. The instruction to cease contracted works and perform out-of-scope activities has caused a program delay of approximately two days. Our project status is now behind program as a direct result of this interruption to planned works sequence. The Contractor requests written confirmation of this variation and approval to proceed with the out-of-scope works beyond the initial two-day period if required. This record is made to document verbal instructions given by the Client Representative.
