Dear Sir/Madam, This letter serves to formally record multiple verbal instructions and directions issued by Client Representatives on 12 May 2026, along with notification of associated commercial and program impacts. VERBAL INSTRUCTION - ACCELERATION OF WORKS Client Representative Chris Green issued a verbal instruction to accelerate works, directing the crew to "hurry up, pull their fingers out and get this job complete because they're way behind in time and costs". This instruction constitutes a directed change to the contracted program and methodology. This record is made to document verbal instructions given by the Client Representative. The Contractor reserves the right to claim additional cost and/or time associated with compliance with this instruction. VERBAL INSTRUCTION - OUT-OF-SCOPE ROCK BREAKING Technical Supervisor Basil Brush directed the Contractor to perform additional rock breaking works at the site. This work was completed over 3 hours and has been identified by the Superintendent as being outside the contracted scope of works. The Contractor reserves the right to claim additional time and cost for this out-of-scope work. This record is made to document verbal instructions given by the Client Representative. VERBAL INSTRUCTION - PLANT DIVERSION Technical Supervisor requested that moxies be diverted to another site, resulting in the excavator standing idle for 2 hours and preventing the Contractor from performing Critical Path works as programmed. This client-directed diversion has caused measurable delay to the project. This record is made to document verbal instructions given by the Client Representative. The Contractor reserves the right to claim additional cost and/or time associated with compliance with this instruction. EXTENSION OF TIME NOTICE The Contractor hereby puts the Principal on notice of potential Extension of Time claims arising from the client-caused delays documented above, specifically the 2-hour Critical Path delay caused by the directed plant diversion. The cumulative impact of these instructions, combined with the Client Representative's acknowledgment that the project is "way behind in time and costs", may result in formal Extension of Time and associated cost claims. HEALTH, SAFETY & ENVIRONMENT INCIDENT A property damage incident occurred involving a Light Vehicle vs Light Vehicle collision in the car park at the technical office. An investigation is underway to determine the cause and implement corrective measures. No injuries were reported. PROGRAM IMPACT The project is experiencing significant delays due to the combination of client-directed changes, out-of-scope works, and resource diversions. These factors, acknowledged by the Client Representative, are impacting the Contractor's ability to complete works in accordance with the original program. The Contractor requests urgent clarification on the prioritisation of works and confirmation of the Client's requirements regarding program acceleration, noting that any acceleration measures will attract additional costs.
