client instructions summary
Work stoppage from 08:30hrs to 12:45hrs (4.25 hours) due to client-directed cessation pending Engineer attendance and re-testing. Production loss: 2.0km of planned sealing not completed (0.5km achieved vs 2.5km target).
Recommended Action
Prepare EOT claim for 4.25-hour delay caused by client-directed work stoppage. Quantify costs: standdown time for crew and plant, demobilisation/remobilisation costs, program impact for 2.0km shortfall. Reference VIRF for verbal instruction. Claim both time extension and associated costs.
Testing discrepancy caused by subcontractor RoadMac using testing equipment one month out of calibration, resulting in test results averaging 1.2 points higher than contractor's results and causing initial failures.
Recommended Action
Formally notify client that subcontractor's (RoadMac) uncalibrated testing equipment caused erroneous failures and work stoppage. Request confirmation that only calibrated testing equipment will be used going forward. Demand calibration certificates for all testing equipment used by client's representatives. Consider back-charge to RoadMac for delay costs if contractor is liable for their testing regime.
Significant production shortfall: 0.5km sealed vs 2.5km target (20% of planned output achieved). Program impact requires recovery strategy or program adjustment.
Recommended Action
Assess program impact of 2.0km shortfall. If EOT is granted, program extends automatically. If contractor required to recover, assess resource uplift requirements and cost implications. Notify client of program impact and proposed recovery strategy (if any). Do not commit to acceleration without agreed compensation.
Client Representative (Roger Rickerby) verbally instructed all works to cease at 08:30hrs pending Engineer re-testing of ball embedment tests due to discrepancy in results between 01 June and 02 June testing.
Recommended Action
Issue VIRF immediately documenting the verbal instruction to cease works. Record instruction time (08:30hrs), instructing party (Roger Rickerby), and resumption time (12:45hrs). Attach to EOT/variation claim documentation. This record is made to document verbal instructions given by the Client Representative. The Contractor reserves the right to claim additional cost and/or time associated with compliance with this instruction.
Engineer was not on site to conduct required visual inspection post-brooming or to verify ITP compliance, causing delay to works commencement and contributing to testing dispute.
Recommended Action
Formally notify client that Engineer's absence prevented timely visual inspection and ITP verification as required by contract. Request confirmation of Engineer attendance schedule for upcoming works to prevent recurrence. Include Engineer non-attendance as contributing factor in EOT claim narrative.
QA/QC personnel not on site during critical inspection period. No photographic evidence available of previous day's testing to verify baseline results and resolve discrepancy.
Recommended Action
Internal action: Implement mandatory photographic evidence protocol for all testing activities with date/time stamps. Ensure QA/QC personnel attendance aligns with critical inspection and testing windows. Brief all testing personnel on calibration verification requirements before commencing tests.
Dear Sir/Madam, We write to formally record verbal instructions received on site on 2 June 2026 and to provide notice of our intention to claim an Extension of Time and associated costs arising from the resulting delays. VERBAL INSTRUCTION RECORD At 08:30hrs on 2 June 2026, your Client Representative, SpongeBob, verbally instructed all works to cease pending Engineer re-testing of ball embedment tests due to a discrepancy in results between 1 June and 2 June testing. Works were permitted to resume at 12:45hrs following satisfactory re-testing, resulting in a total work stoppage of 4 hours and 15 minutes. This record is made to document verbal instructions given by the Client Representative. The Contractor reserves the right to claim additional cost and/or time associated with compliance with this instruction. EXTENSION OF TIME NOTICE We hereby put the Principal on notice of our intention to claim an Extension of Time for the 4.25-hour delay caused by the client-directed work stoppage. This delay resulted in a significant production shortfall, with only 0.5km of sealing completed against our planned target of 2.5km (a shortfall of 2.0km or 80% of planned output). TESTING EQUIPMENT CALIBRATION ISSUE We note that the testing discrepancy was caused by your subcontractor RoadMac using testing equipment that was one month out of calibration. This equipment produced results averaging 1.2 points higher than our calibrated equipment, causing initial test failures and necessitating the work stoppage. We request confirmation that only calibrated testing equipment will be used for all future testing activities and require calibration certificates for all testing equipment used by the Principal's representatives. ENGINEER ATTENDANCE We further note that the Engineer was not present on site to conduct the required visual inspection post-brooming or to verify ITP compliance as required under the contract. This absence contributed to the delay and testing dispute. We request confirmation of the Engineer's attendance schedule for upcoming works to prevent similar delays. We reserve our rights to claim additional time and costs associated with this delay, including but not limited to standdown time for crew and plant, demobilisation and remobilisation costs, and program impact arising from the production shortfall. We trust this matter will receive your urgent attention and look forward to your response. Yours faithfully, [Contractor Representative]

client stopped the seal at section A at 8:00am. He required ball embedment test results to confirm the basecourse was within the spec. He asked the subcontractor to do tests with their tool while he waited for the engineer to turn up. As RoadMac do their own tests before any sealing.
Not on site at the time of inspection. No photo evidence of yesterday's testing.
Superintendent made it known that client was holding the work up due to test results off an uncalibrated tool . These results where an average of 1.2 points higher than what our test results from yesterday and all failed. Unfortunately when our tester came out and retested as per client instructions, they also failed. Work ceased untill 12:45pm when we retested and the numbers came in as passes. We only sealed 0.5km instead of 2.5km
