Dear Sir/Madam, This letter serves as formal notice of a verbal instruction received from your representative, Mr HanRoy, at 06:00 hours on 9 May 2026. Mr HanRoy instructed that ramp construction at the station intersection (CH 210.270) must be completed before 16 May 2026. This instruction requires the immediate cessation of all programmed works and the diversion of all personnel and plant resources to this ramp construction for a period of three (3) days. We advise that this ramp construction work is outside the scope of the original contract. The Contractor reserves the right to claim additional time and cost associated with this out-of-scope work, including but not limited to: - Direct costs for three days of diverted resources (personnel and plant) - Program delay costs resulting from the cessation of contracted works - Any acceleration costs required to recover the program Furthermore, we put the Principal on notice that this instruction will result in a delay to the contracted program. The Contractor reserves the right to submit an Extension of Time claim for the three-day period during which programmed works will be suspended, plus any consequential delays to downstream activities on the critical path. We note that during this period, our digger has also experienced a breakdown with no operational hours recorded. This equipment failure, combined with the resource diversion, will compound the program impact. All available resources have been redirected to the client priority works as instructed, preventing delivery of contracted program milestones during this period. This record is made to document verbal instructions given by the Client Representative.
