Ms Doyle instructed our site team to relocate the excavator and perform alternate works. This instruction resulted in the diversion of plant from the scheduled culvert excavation program and caused 1.0 hour of idle/redeployment time during the transition. Our site Superintendent has advised that the contractual status of these instructed works is uncertain, and it remains unclear whether the works fall within the existing contract scope or constitute a variation to the contract. We hereby put the Principal on notice that the Contractor reserves its rights to claim additional cost and/or time associated with these instructed works, pending clarification of their contractual status.
